Please note the urn in the Right on the Niche wall. This is Phillip A. Finnegan’s
urn which has been moved from the location which he bought in 2000. The right location is one (1) below this location shown
in the picture. The lower area was open illegally by staff and Management of Trinity
Memorial Gardens, 12609 Memorial Drive, New Port
Richie, Florida 34655.
I am disabled and have no transportation and had not been to the cemetery for several years. I found the energy and drive
to hitch hick out to the cemetery and took a camera with me so I could take pictures and visit this person. I have control
over Mr. Finnegan’s niche and also am the owner of a niche below his true location. I also wanted to visit the niche
of Mr. Terry A. Becker who is also located in this “Memorial Wall”. Mr.
Becker had an Associate who was his executor of his will and told the cemetery management that he had “Power of Attorney”
over me to move Mr. Finnegan’s urn and contents. This was untrue. Mr. Becker had my Durable Power of Attorney till September
2005 when he and I agreed it was no longer needed. Under Florida
State Law the Durable Power of Attorney dies with Mr. Becker. Mr. James
Goudry of Dade City and Lutz, Florida and also the owner
of Keith’s Lounge on North Nebraska Avenue (between
Skipper and Berass Avenue) told the staff he had this
power.
I was so upset with this when I saw it. I could not get to the office as the Office closed that Saturday,
June 30th, 2007 at 4pm. I contacted Mr. Tim Schurdell who is the sales person who arranged Mr. Finnegan’s
buying contract and also assisted him with one “Tom” who was the Funeral Director of the operation at that time.
Mr. Schurdell also sold me the “niche” below Mr. Finnegan when I came to the cemetery to make his final arrangements
after he passed away in December 2001. His file shows that I paid all the final bills and arranged his placement in the niche.
The move of Mr. Finnegan’s remains is in violation of Florida
State Laws. Since Mr. Goudry used Fraud and Deception to do this. If
a person uses a Power of Attorney a copy of this attorney should then be placed in file with the cemetery. The action comes
from one (1) of the investors of the Cemetery and or Funeral home by a person who is not active with the day to day operations.
This person is one Dr. James P. Gills, MD of the St. Luke’s Cataract and Laser Institute of Tarpon Springs, Florida. Mr. Gills has pushed and pulled
at the cemetery as it was his invention. Dr. Gills was upset that I placed a picture taken only weeks before Mr. Finnegan
passing at Memorial Hospital.
I was his living will representive and all papers are in his medical file as well as my durable power of attorney for Mr.
Finnegan. Several weeks prior to his passing a picture was taken of me and a friend standing behind Mr. Finnegan at a local
bar in Tampa Florida. I was
bending over and kissing him on the cheek. He was a wonderful and warm man. This picture along with one of him and his dog
“Sparkie” on the couch at our apartment was put in the niche with him. This was a temporary thing as I did not
have time to decorate the niche as I do now. The problem was that Dr. Gills and several others deemed it inappropriate as
it smacked of Gay. Mr. Finnegan requested that this picture be in his niche with the one with Sparkie his dog. This request
was made on his death bed at Memorial Hospital.
I installed this picture and closed the niche. I have the right to open and close the niche and remove him at will when I
pay a fee to the Cemetery. Mr. Goudry wanted to impress the staff and thus got them to move him when he had a viewing, I believe,
of Mr. Becker’s decorated niche. It was also a viewing for his two other roommates that are also interned at this location.
To me this is considered a “hate crime” and also a violation of my civil rights. There is no information in the
contract that I have seen forbidding this picture. I am deeply hurt and want prosecution of the Corporation of Trinity and
the Funeral home operation. The current Funeral Director is Mr. John Williams who with Mr. Schurdel did move and authorize
this movement. I would like to use U.S.
Federal Crimes Statutes on this crime.
I personally went to the Circuit Court State Attorney’s office and requested help. They could
not help me as it was a crime was in Pasco County.
I was not aware that I had to file these charges in Pasco County. I do not have a car and I am disabled and could not get back to Pasco to file these charges. An investigator with the State Attorney’s office gave
me a number to contact the police there and I took a bus that same day to UATC Bus Station on the Hart Line to call this number
and ask for a police officer to come to me. This was the closest area to Pasco
County I could get. I was told by the dispatcher that an officer would
call me back at the number. I waited at the location for over 45 minutes and again called the number which is long distance
and was told that a officer was given the complain and was going to call. I waited another 1 or longer and he or she never
called. I was tired and totally exhausted and left. In other words I got no response from the Pasco County Sheriff’s office at all.
I decided that I was going to file a Complaint with the Federal Authorities which I am doing at this
time. I am hoping that the United States Attorney’s Office in Tampa, Florida will file Federal Charges
or assist me in having this action filed. I believe Federal, State and County laws have been broken. I was told by a friend
that just opening the niche and moving Mr. Finnegan was a 3rd degree felony in Florida. I am asking for help in prosecution of the guilty in this matter. I am greatly
hurt and from this I did have a Heart Seizure and ended up in Tampa General this past Saturday and spent several days undergoing
testing. I have never ever been so hurt.
It should be known that Pasco County State Attorney may not be able to take the case as the Cemetery in this complain
also uses the County Cemetery and may operate this for the County.
